Vape Africa is an online vape store supplying various vape products and brands to clients for online purchase.

Any person who orders any products from this website needs to be at least 18 years of age and agree to the following terms and conditions:

Delivery policy

Subject to availability and receipt of payment, requests will be processed within 2 days and delivery confirmed by way of email and courier tracking. (for e.g. booking number / booking voucher etc. and must mention the use of courier and/or postal services and associated costs, if applicable.)

Export restriction:

The offering on this website is available to South African clients only.

Return and Refunds policy

The provision of goods and services by Vape Africa is subject to availability. In cases of unavailability, Vape Africa will refund the client in full within 30 days. Cancellation of orders by the client will attract a 20% administration fee.

Customer Privacy policy

Vape Africa shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.polity.org.za/attachment.php?aa_id=3569.

Payment options accepted

Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Vape Africa bank account, the details of which will be provided on request.

Card acquiring and security

Card transactions will be acquired for Vape Africa via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

Customer details separate from card details

Customer details will be stored by Vape Africa separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.

Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

Responsibility

Vape Africa takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

Country of domicile

This website is governed by the laws of South Africa and Vape Africa chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, in relation to Vape Africa.

Variation

Vape Africa may, in its sole discretion, change this agreement or any part thereof at any time without notice.

Returns Policy

General

1.1.1 applies to customers who have purchased item(s) through the VAPE AFRICA (PTY) LTD web site or any retail outlets that carry our products or our own retail stores.
1.1.2 forms an integral part of the VAPE AFRICA (PTY) LTD Terms and Conditions.
1.2 Subject to the provisions of the Consumer Protection Act, 68 of 2008 (hereafter referred to as “CPA”) and / or any other applicable law, all item(s) sold to the Customer shall be regarded as having been sold as is, without warranty against latent defects; see point 3.
1.4 The Customer shall be entitled to return items purchased, to VAPE AFRICA (PTY) LTD, where the Customer is legally entitled to do so under the provisions of the Consumer Protection Act, 68 of 2008 (“CPA”) see point 3, or the Electronic Communications and Transactions Act 25 of 2002 (hereafter referred to as “ECTA”); see point 2.

1.5 If a refund has been authorised and processed, kindly allow up to 7 working days for the money to reflect in your bank account.

The Right to Return Goods in terms of ECTA

2.1 In terms of section 44 of ECTA you have the right to cancel any electronic transaction for the supply of certain items within seven days after the date of receipt of the goods and to obtain a full refund for those items within 30 days of the date of cancellation.

2.2 Where the goods have already been delivered to you, you will be liable for the direct cost of returning the goods to us (which cost shall include a handling fee of up to 10%).
2.3 Certain items, including e-liquids, coil rebuilding supplies (but not limited to), are excluded as described in Section 42.2.C as “other goods intended for everyday consumption”

2.3 In order to initiate a return, subject to any offsets of costs in terms of 2.2 above, please follow the process below:

2.3.1 Within 7 days of receiving the item , provide VAPE AFRICA (PTY) LTD with your written notice of cancellation via e-mail to adevries@telkomsa.net or vapeboss@telkomsa.net
2.3.2 After confirmation from VAPE AFRICA (PTY) LTD, you may initiate return of the items to VAPE AFRICA (PTY) LTD, at your own cost. VAPE AFRICA (PTY) LTD can arrange for the return of the items, in which case the cost of the return freight, together with a possible handling fee, shall be deducted from the refund of the purchase price of the item(s). Note that item(s) must be returned to VAPE AFRICA (PTY) LTD premises directly and must be securely packaged. The package must also include details of the customer and original order particulars.

2.3.3 Please ensure that the item(s) returned are new and unused, in their original packaging with all accessories, undamaged and in a sale-able condition.

2.4 VAPE AFRICA (PTY) LTD reserves the right to refuse to accept the return of item(s) if any of the conditions which are set out in 2.3 above are not followed.

The right to return item(s) in terms of the CPA (defects)

3.1 In terms of the CPA, all item(s) sold to Consumers (as defined in the CPA) shall carry a 6 month warranty against defects.

3.2 Accordingly, in the event that item(s) which are sold to customers (termed “Consumers” in the CPA) are found to be defective within 6 months from the date of delivery of the item(s) to the customer, the customer shall be entitled to return the item(s) to VAPE AFRICA (PTY) LTD and to demand the repair of the item(s) or the replacement of the item(s) or a refund on the condition that:

3.2.1 The customer informs VAPE AFRICA (PTY) LTD via email to adevries@telkomsa.net or vapeboss@telkomsa.net, as soon as possible after the customer becomes aware of the defect, but within 6 months after delivery / collection of the item(s).

3.2.2 The customer returns, at his/her own expense, the item(s) to VAPE AFRICA (PTY) LTD within the 6 month warranty period together with all accessories that were sold with the defective item;

3.2.3 VAPE AFRICA (PTY) LTD may inspect and / or test the item(s) so as to confirm the defect. Inspection may determine that:

3.2.3.1 The item(s) are indeed defective in which case VAPE AFRICA (PTY) LTD shall refund the customer the delivery charges incurred for the return of the item(s) to VAPE AFRICA (PTY) LTD; refund/repair/replace the item as per the customer’s preference.

3.2.3.2 If the item(s) are found not to be defective the customer will be notified of this finding and informed of the associated cost of return.

3.3 The following shall not be regarded as “defects” in the item(s):

3.3.1 Faults resulting from normal wear and tear; including cosmetic damage;
3.3.2 damage arising from negligence, user abuse or incorrect usage of the item(s);
3.3.3 damage arising from electrical surges;
3.3.4 damage arising from a failure to adequately care for the item(s);
3.3.5 damage arising from unauthorized alterations to the item(s); and
3.3.6 where the specifications of the item(s), although accurately described on the web site and generally fit for its intended purpose, does not suit you.
3.3.7 damage to mechanical connections after 90 days of date of purchase;
3.3.8 damage to electrical connections (USB ports etc) after 14 days of date of purchase as these items are susceptible to damage from static electricity discharge and charging adapters which do not comply with applicable standards and are beyond VAPE AFRICA (PTY) LTD ‘s control.
3.3.9 damage of any kind resulting from falls
3.4.1 damage resulting from e-liquid or liquids of any kind.
3.4.2 Damage resulting from incorrect operation including but not limited to; incorrect coil installation, using counterfeit batteries, using clone products in conjunction with your product.
3.4.3 opening of the device instantly voids warranty.
3.4.4 damage resulting from improper battery orientation.
3.4.5 Any and all damages resulting from the use of an aftermarket rebuildable tank of any kind on a device that has been sold in kit form with a sub ohm tank.

Incorrect Goods delivered

4.1 The onus rests on the customer to ensure that the item(s) ordered are appropriate for their intended use and / or purpose.

4.2 In the event that incorrect item(s) are delivered to the customer, the customer should notify VAPE AFRICA (PTY) LTD via e-mail to adevries@telkomsa.co.za or vapeboss@telkomsa.net, of the error. The customer must not remove the item(s) from their packaging or use the item(s) in any way.

4.3 VAPE AFRICA (PTY) LTD shall arrange the collection of the incorrectly supplied item(s) from the customer and shall deliver the correct item(s) (as initially ordered by the customer) to the customer as soon as possible.
4.4 VAPE AFRICA (PTY) LTD shall not be held liable for any damages of any nature whatsoever, due to late or delayed deliveries of the item(s) ordered by the customer.

Goods damaged on delivery

Should item(s) be damaged or missing any parts or accessories at the time of delivery / collection, the customer must please notify VAPE AFRICA (PTY) LTD within 2 days of such the delivery / collection. VAPE AFRICA (PTY) LTD will arrange to collect the item(s) from the customer at no charge, where the item(s) was originally ordered for delivery. Once VAPE AFRICA (PTY) LTD has inspected the item(s) and are able to validate the damage, VAPE AFRICA (PTY) LTD will replace the item(s) as soon as possible or refund the customer account with the full purchase price of the item(s) including shipping, where applicable.
